In 2022, Coinbase petitioned the SEC for guidance on how to comply with federal securities law. Instead of acting on the petition, the SEC sued Coinbase for alleged securities violations. As a federal judge recently put it, the SEC’s response to Coinbase’s request was, in effect, “You won’t know the answer until we come after you.” This ordeal is emblematic of the crypto industry’s struggle to placate hostile regulators and make sense of rules that long predate the advent of blockchain technology.
